READ CAREFULLY BEFORE COMPLETING APPLICATION

These terms and conditions set out what is agreed between us in relation to your submission
in whole or in part of or to a script or screenplay or audiovisual material to be considered for
inclusion on the pages of the site. These terms and conditions
together with the relevant terms and policies contained within our website at

By submitting material to us including (but not limited to) digital audio files, text, graphics,
photographs, artwork, literary work, musical works, sound recordings and films (“the
Material”) you grant to Devolution Digital Productions Limited the right to exploit the Material
and authorise others to do so by any and all means in any and all media in perpetuity.
•
You confirm the irrevocable and unconditional grant to Devolution Digital Productions Limited
its successors assigns and licensees in respect of the Material all consents required
pursuant to the Copyright, Designs and Patents Act 1988 Part II and all other laws now or in
future in force in any part of the world which may be required in respect of the exploitation of
the Material by Devolution Digital Productions Limited its successors assigns and licensees
in any or all media by any and all means now known or developed in future for the full
duration of the rights acquired by Devolution Digital Productions Limited pursuant to these
terms and conditions pursuant to the laws in force in any part of the world.

You confirm to Devolution Digital Productions Limited the irrevocable and unconditional
waiver by you and all personnel whose contribution is contained within the Material of all
rights to which such persons are now or may in the future be entitled pursuant to the
provisions of the Copyright, Designs and Patents Act 1988 Sections 77, 80, 84 and 85 and
any other moral rights to which such persons may be entitled under any legislation now
existing or in future enacted in any part of the world.

The decision as to the suitability of the Material for inclusion on our Site will be made solely
by Devolution Digital Productions Limited whose decision will be final.
•
You must be at least 12 years old at the date of completion of this form. You will provide us
upon our request for the same with supporting documentation in order to substantiate this.
•
All personal details and/or information given in your application either in this form or
otherwise must be truthful, accurate and in no way misleading.
•
You warrant that you are not a party to a publishing or other agreement relating to the
Material and are under no contractual or other obligations which are inconsistent with this
application.
•
You warrant that the Material and the use of the Material by us will not infringe the copyright,
performers’ rights, moral rights, rights of privacy or confidence or other rights of any third
party; will not be obscene, blasphemous, defamatory or otherwise illegal or unlawful, or in
any way incite racial hatred; that it does not contain and will not produce any known viruses
or harmful codes that could damage our systems or data; that it does not include any so-
called “sampled” extracts from any third party sound recordings or films or include or utilise
any literary or other copyright work not controlled by you; and complies and adheres to our
website terms and conditions and policies.

You will indemnify us against any loss, damages, costs, expenses (including legal fees on a
full indemnity basis) or other claims arising from a breach by you of these terms and
conditions.
•
We shall not be liable to you by reason of any representation and all warranties, conditions
or other terms implied by law are excluded to the fullest extent permissible. We shall not be
liable for any loss or goodwill or reputation, profit or any indirect, special or consequential
loss, damage, costs, expenses or other claims (whether caused by our negligence, that of
our servants or agents or otherwise) which arise out of or in connection with the provision of
the Material.
